A summary of recent regulatory updates, notifications, and technical bulletins from the Canada Border Services Agency and other federal government departments, agencies and administrative entities concerning Canadian imports and exports.

Canada Border Services Agency

COR2 2019 IN: Certain Corrosion-Resistant Steel Sheet
Statutory notification pursuant to SIMA that the CBSA has extended the time (to 135 days) for making preliminary determinations regarding investigations into the alleged injurious dumping/subsidizing of certain corrosion-resistant steel sheet originating in or exported from Turkey, Vietnam and the United Arab Emirates.

LP2 2020 UP1: Carbon and Alloy Steel Line Pipe
Statutory notice that the CBSA has initiated a review in connection with a prior finding of injury by the CITT to update all normal values and export prices of certain carbon and alloy steel line pipe (line pipe) exported from South Korea to Canada by SeAH Steel Corporation (SeAH).

FISC 2020 SP: Certain Fabricated Industrial Steel Components
Statutory notice pursuant to SIMA that the CBSA has initiated a scope proceeding respecting the dumping of certain industrial steel components imported from China, South Korea and Spain, and whether or not specialized prefabricated process units are subject to a prior injury finding by the CITT.

SR2 2019 IN: Certain Sucker Rods
Statutory notice pursuant to SIMA of undertakings received by the CBSA from certain exporters in Argentina, Brazil and Mexico committing to revise selling prices of sucker rods to Canada in order to eliminate the margin of dumping/injury previously determined.

CPF 2020 UP1: Copper Pipe Fittings
Statutory notice that the CBSA has initiated a review to update the normal values and export prices of certain copper pipe fittings exported to Canada from the U.S. by Nacobre USA LLC in connection with prior material injury findings of the CITT.

Customs Notice 20-02: Amendments to the Departmental Consolidation of the Customs Tariff
Notification that effective January 10, 2020, Section Note XI of the Customs Tariff has been updated to give effect to Article 317 of the Canada-Colombia Free Trade Agreement.

Memorandum 2020-01: Renewal of Veterinary Biologics Establishment Licences, Product Licences, and Import Permits
Reminder that annual import permits expire April 30, 2020, and establishment licences (Veterinary Biologics Establishment Licence) and product licences (Veterinary Biologics Product Licence) expire May 31, 2020.

RR-2019-005: Oil Country Tubular Goods from China
Expiry review pursuant to SIMA regarding the dumping and subsidizing of certain “oil country tubular goods” originating in or exported from China.

AP-2018-053: Rona Inc. v. President of the CBSA
Appeal regarding the classification of the “Outdoor Kaleidoscope Projection Lightshow” which the CBSA maintains is provided for under heading 94.05 as “Lamps and lighting fittings including searchlights and spotlights and parts thereof, not elsewhere specified or included” (9405.40 as “Other electric lamps and lighting fittings”). Rona contended the goods should instead be classified under 9008.50.90 as “Other image projectors” or alternatively under 9505.10.00 as “Other Christmas decorations.” Based on evidence showing that the predominant purpose of the goods is to provide illumination, the CITT determined the goods are excluded from classification under heading 95.05 and furthermore concluded that heading 90.08 is not applicable as the goods project moving as opposed to still images. Accordingly, the appeal was dismissed.

GC-2018-001-E2: Certain Steel Goods
Notification that the CITT has commenced an inquiry regarding possible exclusions to the government’s safeguard measures (5%-25% duty surtax) concerning imports of certain heavy plate and stainless steel wire.

RR-2018-008: Aluminum Extrusions
Expiry review pursuant to SIMA regarding the dumping and subsidizing of certain aluminum extrusions, originating in or exported from China.

SOR/2020-10: Order Amending the Schedule to the Customs Tariff
The Order Amending the Schedule to the Customs Tariff implements, in Canada, the bilaterally agreed “short supply” list of yarns and fabrics that are not produced in Canada or Colombia in accordance with provisions of the free trade agreement between the two countries (CCOFTA).

Notice of intent to amend certain hunting provisions in connection with the Wild Animal and Plant Trade Regulations in order to reflect changes to the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
