A summary of recent regulatory updates, notifications, and technical bulletins from the Canada Border Services Agency and other federal government departments, agencies and administrative entities concerning Canadian imports and exports.

Customs Notice 18-23: Amendment to the Departmental Consolidation of the Customs Tariff
Notification that as a result of the Comprehensive and Progressive Trans-Pacific Partnership Tariff Agreement coming into force, numerous additions and deletions have been made to the September 1, 2018 version of the Departmental Consolidation of the Customs Tariff.

Customs Notice 18-22: Implementation of the CPTPP
Notification that the Comprehensive and Progressive Agreement for Trans-Pacific Partnership will be implemented in Canada, Australia, Japan, Mexico, New Zealand and Singapore on December 30, 2018, and will enter into force for Vietnam on January 14, 2019.

Customs Notice 18-21: Customs Self Assessment Authorizations
Notice that CBSA has amended the Accounting for Imported Goods and Payment of Duties Regulations to replace the “Good Character” terminology with more precise wording that explains how the CBSA assesses eligibility for membership in the CSA program.

Memorandum D2-6-7: Use of Form BSF241, Non-monetary General Receipt
D-Memo outlining the use of Form BSF241, Non-monetary General Receipt (applicable to goods or currency and monetary instruments that are abandoned to the Crown or detained by CBSA) updated following a technical review to make various substantive revisions.

Memorandum D14-1-3: Re-determinations and Appeals Under the Special Import Measures Act
D-Memo explaining the procedures to request re-determinations and file appeals under the Special Import Measures Act has been revised to add re-determinations for the purpose of applying a scope ruling.

Memorandum D2-2-3: Seasonal Residents’ Effects – Tariff Item No. 9829.00.00
Revisions to the text following a technical review, but which do not affect or change any of the existing guidelines or procedures contained in the D-Memo.

Memorandum D2-1-4: Casual Donations – Tariff Item No. 9816.00.00
D-Memo regarding interpretation of tariff item No. 9816.00.00 (gifts valued up to $60, excluding advertising matter, tobacco or alcoholic beverages) has been updated as a result of a technical review.

FISC-2018-SP-02: Certain Fabricated Industrial Steel Components
Notice of a proceeding in connection with a scope ruling determining whether the well pair modules, termination modules and metering modules of Shanghai Shuangyan Chemical Equipment Manufacturing Co. are subject to a 2017 CITT injury finding concerning the dumping of certain FISC from China, South Korea and Spain, and subsidization in the case of Chinese goods.

FISC-2018-SP: Certain Fabricated Industrial Steel Components
Notification that CBSA pursuant to SIMA has made a scope ruling that the fabricated industrial steel components (FISC) portion of Woodfibre LNG Limited’s LNG modules including pipe rack modules are subject to a 2017 finding by the CITT concerning the dumping of certain FISC from China, South Korea and Spain, and subsidization in the case of Chinese goods.

CT-2018-ER: Copper Tube
Notice that the CITT has initiated a review investigation to determine, pursuant to SIMA, whether the expiry of a 2013 finding is likely to result in the continuation or resumption of dumping of certain copper tube originating in or exported from Brazil, China, Greece, Mexico and South Korea, and subsidizing in the case of Chinese goods.

TR-2018-UP-01: Liquid Dielectric Transformers
Statutory notice that the CBSA has initiated a review to update the normal values and export prices of certain liquid dielectric transformers exported from South Korea to Canada by Hyundai Electric & Energy Systems Co., Ltd. as part of the CBSA’s enforcement of the CITT’s finding of injury, first made in 2012 and still currently ongoing.

RB1-2018-UP-ICDAS & RB1-2018-UP-COLAKOGLU: Concrete Reinforcing Bar
Notification of closure of the reviews to update the normal values and export prices applicable to certain concrete reinforcing bar (rebar) exported to Canada from Turkey by IÇDAŞ Celik Enrji Tersane ve Ulasim Sanayi A.S. (Içdaş) and Çolakoğlu Metalurji A.S.

MHD 2018-22: Indonesia
Information concerning Indonesia in the Meat Hygiene Manual of Procedures has been updated to indicate that the Import Recommendation Number must be mentioned in the Additional Certification section of CFIA 1454.

Notification that CFIA has updated the List of establishments approved to export live or raw molluscan shellfish from Ireland to Canada by adding Dublin-based Synergy Foods Limited.

Web Notice 20181120: Evaluation of the REGAL Program
Advisory that CFIA is seeking feedback from stakeholders concerning an alternative service delivery program used to test grain exports for phytosanitary certification. REGAL was launched earlier in 2018 and is currently available on a voluntary basis to grain exporters who are required to have their grain shipments tested for all types of crops being exported to: India, China, Mexico and Vietnam.

RR‑2018‑006: Structural Tubing
Statutory notice that pursuant to SIMA the CITT will initiate an expiry review of its 2013 finding concerning the dumping of certain structural tubing known as hollow structural sections made of carbon and alloy steel originating in or exported from South Korea and Turkey.

RR-2017-006: Seamless Carbon or Alloy Steel Oil and Gas Well Casing
Following an expiry review pursuant to SIMA concerning the dumping and subsidizing of seamless carbon or alloy steel oil and gas well casing originating in or exported from China, the CITT has determined to continue its prior order (initially made in 2008 and continued in 2013), without amendment, in respect of the subject goods.

RR‑2018‑005: Circular Copper Tube
Notice that the CITT will be initiating an expiry review of a 2013 order scheduled to expire on December 17, 2018, concerning the dumping of certain circular copper tube originating in or exported from Brazil, Greece, China, South Korea, Mexico, and subsidizing in the case of Chinese goods.

PI-2018-006: Nitisinone Capsules
Notification that pursuant to SIMA the CITT has made a preliminary determination that the dumping of certain capsules and tablets of nitisinone originating in or exported from Sweden has caused injury to the domestic industry.
