A​​​​​​​​​​​​​​​​​​​​​​​​​​​​s relayed by the National Customs Brokers & Forwarders Association of America (NCBFAA), Customs and Border Protection (CBP) has informed the U.S. Court of International Trade that it is now focused on expanding the Consolidated Administrative and Processing of Entries (CAPE) system to process IEEPA tariff refunds for customs entries flagged for reconciliation, with the capability expected by June 29. CBP reports significant progress under CAPE Phase 1, including more than 16 million entries processed and approximately $22 billion in completed refunds. Meanwhile, the Department of Justice has asked the court to maintain the suspension of immediate compliance.

CBP Expands CAPE Processing to Reconciliation Entries

CBP advised the U.S. Court of International Trade on June 9 that it has turned its attention to expanding functionality for customs entries flagged for reconciliation to receive IEEPA tariff refunds. According to CBP, this reconciliation processing capability should be available on June 29.

Once the reconciliation functionality is deployed, CBP will further expand CAPE functionality to cover additional categories of entries, including entries filed by plaintiffs to actions before the CIT and for which reliquidation is needed.

CAPE Phase 1 Progress So Far

CBP reported the following progress since the launch of CAPE Phase 1:

  • More than 16 million entries have been processed through the system.
  • More than $89 billion in both potential and certified refunds of IEEPA duties have been accepted for processing.
  • Approximately $22 billion in refunds have been completed and sent to the Treasury Department for disbursement.

DOJ Requests Court Maintain Suspension of Immediate Compliance

The Department of Justice has requested that the court not lift the suspension of immediate compliance.

“Alternatively, it should stay the injunction pending appeal. If the Court lifts the suspension, it should administratively stay its injunction for seven days to permit orderly proceedings in the Federal Circuit,” the DOJ said.
