AD/CV Duty Investigations Initiated on Steel and Molded Fiber

he U.S. Department of Commerce (Commerce) and the U.S. International Trade Commission (USITC) have launched have launched new antidumping (AD) and countervailing duty (CVD) investigations. These investigations cover specific imports of corrosion-resistant steel products and thermoformed molded fiber products from multiple countries. The aim is to determine whether these goods are being imported at unfairly low prices or are benefiting from subsidies, potentially harming U.S. industries.

CORE: AD and CVD Investigations

Corrosion-resistant steel products (CORE), including galvanized and coated steel, are currently undergoing both AD and CVD investigations due to significant imports from several countries.

Antidumping (AD) Investigations:
The countries subject to
AD investigations include Australia, Brazil, Canada, Mexico, the Netherlands, South Africa, Taiwan, Türkiye, the United Arab Emirates (UAE), and Vietnam. These investigations focus on whether the imports are being sold in the U.S. at prices below fair value.

Countervailing Duty (CVD) Investigations:
Countries facing
CVD investigations include Brazil, Canada, Mexico, and Vietnam. These investigations assess whether the imports benefit from unfair government subsidies that distort market competition and disadvantage U.S. producers.

      Dumping Margins:

      • Australia: 45.86 to 51.79%
      • Brazil: 52.03 to 107.67%
      • Canada: 19.73 to 52.08%
      • Mexico: 27.46 to 41.94%
      • The Netherlands: 12.70 to 20.51%
      • South Africa: 53.81 to 53.86%
      • Taiwan: 67.81%
      • Türkiye: 18.30 to 34.59%
      • UAE: 77.09 to 78.53%
      • Vietnam: 195.23%

      Products Affected:

      The products under review include flat-rolled steel products, coated with metallic and non-metallic substances to enhance corrosion resistance. The primary use of these products is in the construction, automotive, and appliance industries.

      The products subject to the investigations are currently classified in the Harmonized Tariff Schedule of the United States (HTSUS) under item numbers: 7210.30.0030, 7210.30.0060, 7210.41.0000, 7210.49.0030, 7210.49.0040, 7210.49.0045, 7210.49.0091, 7210.49.0095, 7210.61.0000, 7210.69.0000, 7210.70.6030, 7210.70.6060, 7210.70.6090, 7210.90.6000, 7210.90.9000, 7212.20.0000, 7212.30.1030, 7212.30.1090, 7212.30.3000, 7212.30.5000, 7212.40.1000, 7212.40.5000, 7212.50.0000, 7212.60.0000, 7225.91.0000, 7225.92.0000, 7226.99.0110, and 7226.99.0130.

      The products subject to the investigations may also enter under the following HTSUS item numbers: 7210.90.1000, 7215.90.1000, 7215.90.3000, 7215.90.5000, 7217.20.1500, 7217.30.1530, 7217.30.1560, 7217.90.1000, 7217.90.5030, 7217.90.5060, 7217.90.5090, 7225.99.0090, 7226.99.0180, 7228.60.6000, 7228.60.8000, and 7229.90.1000.

      Thermoformed Molded Fiber Products: New AD/CVD Investigation

      A separate investigation, launched on October 15, 2024, focuses on thermoformed molded fiber products from China and Vietnam. These biodegradable packaging materials are alleged to be dumped in the U.S. market at prices below fair market value. The alleged average dumping margins are 604.4% for China and 328.52 % for Vietnam.

      Product Description:

      Thermoformed molded fiber products are sustainable packaging solutions made from recycled paper pulp, commonly used in food service packaging (plates, bowls, lids, trays, clamshells, and inserts) and other types of consumer goods packaging.

      The products subject to the investigations are currently classified in the Harmonized Tariff Schedule of the United States (HTSUS) under item numbers: 4823.70.0020 and 4823.70.0040 and may also be classified under 4823.61.20, 4823.61.40, 4823.69.20, and 4823.69.40.
