AD/CVD on Aluminum Containers from China and Molded Fiber Products from Vietnam

he U.S. Department of Commerce published its preliminary determination in the less-than-fair-value (LTFV) investigation concerning disposable aluminum containers, pans etc. imported from China. The determination was later affirmed in the final ruling, reinforcing the application of antidumping duty (AD).
Similarly, a preliminary affirmative countervailing duty (CVD) determination was issued concerning thermoformed molded fiber products from Vietnam, indicating the existence of countervailable subsidies.
Aluminum Containers from China
Commerce finalized its preliminary determination that disposable aluminum containers from China were being dumped into the U.S. market at a weighted-average dumping margin of 193.90% for individually examined producers and exporters. The China-wide entity received a higher margin of 287.80% based on adverse facts available (AFA).
Scope of Investigation
The investigation covered disposable aluminum containers, pans, trays, and lids made primarily from flat-rolled aluminum. These products are generally used for food-related applications such as packaging, baking, and reheating. However, excluded from the scope are disposable aluminum casks, drums, cans, boxes, cups, and bottles classified under HTSUS subheading 7612.90. However, aluminum containers, pans, trays, and lids that would otherwise be covered by the scope are not excluded based solely on the fact that they are being classified under HTSUS subheading 7612.90.5000 due to the thickness of aluminum being less than 0.04 mm or greater than 0.22 mm.

Thermoformed Molded Fiber Products from Vietnam
Commerce preliminarily determined that countervailable subsidies are being provided to producers and exporters of molded fiber products from Vietnam. The investigation covers molded fiber products used for food and packaging applications.
Preliminary Affirmative Determination of Critical Circumstances
Commerce preliminarily found that critical circumstances exist for imports of subject merchandise from certain Vietnamese exporters, including:
- Vietnam Yuzhan Packaging Technology Co., Ltd. (3.39%)
- HC Packaging Asia (Industrial Park) (173.51%)
- Honha Eco Pulp Viet Nam Paper Tray (173.51%)
- Pulp Tray, Martin Vietnam Co., Ltd. (173.51%)
- All others (3.39%)

U.S. International Trade Commission (ITC) Notification
Commerce has notified the U.S. International Trade Commission (ITC) of its final determinations. The ITC will now determine whether the domestic industry is materially injured by imports of disposable aluminum containers from China and thermoformed molded fiber products from Vietnam. If the ITC issues an affirmative determination, Commerce will issue an antidumping duty order, enforcing cash deposit requirements for applicable entries.
