Comment Period Open for Tariffs on Certain Imports from China

he Office of the United States Trade Representative (USTR) has announced a call for public comments concerning proposed modifications to Section 301 tariffs, particularly related to China’s policies around technology transfer, intellectual property, and innovation. These changes are aimed at addressing ongoing concerns about China’s economic practices, with a focus on five additional subheadings in the Harmonized Tariff Schedule of the United States (HTSUS).

HTSUS Subheadings Targeted

The USTR is proposing to increase the China Section 301 tariffs to 25% for the following HTSUS subheadings:

  • 8101.94.00 (tungsten, unwrought (including bars and rods obtained simply by sintering))

  • 8101.99.10 (tungsten bars and rods (other than those obtained simply by sintering), profiles, plates, sheets, strip and foil)
  • 8101.99.80 (tungsten, articles not elsewhere specified or included)

USTR is also proposing to increase the tariffs to 50% on the following HTSUS subheadings.

  • 2804.61.00 (silicon containing by weight not less than 99.99 percent of silicon)
  • 3818.00.00 (chemical elements doped for use in electronics, in the form of discs, wafers, etc., chemical compounds doped for electronic use)

Request for Public Comments

The USTR is seeking feedback from businesses, consumers, and industry experts to ensure that the proposed modifications are both effective and balanced. Commenters are encouraged to address:

  • The effectiveness of the proposed changes in curbing China’s unfair practices
  • The impact of these tariffs on U.S. businesses and consumers, particularly in high-tech sectors
  • Whether the selected subheadings cover the relevant products and sectors adequately

Submission Process

To ensure transparency, USTR has provided a web portal for submitting comments, which opens on September 23, 2024, and will remain open until October 22, 2024. Interested parties can submit comments without the need to create an account, and both public and business confidential information can be provided through the portal here.
