.S. Customs and Border Protection (CBP) has released a new Unstacking Certain Tariffs Chart to help importers identify which Presidential Proclamations and Executive Orders may apply to their products.

The chart is designed to help determine whether multiple tariffs could “stack” on the same product under Section 232 or the International Emergency Economic Powers Act (IEEPA).

Note: CBP notes that the official language in each Executive Order, Proclamation, and Federal Register notice governs tariff application, emphasizing that the chart is informational only and does not constitute an official interpretation of tariff obligations. Importers remain responsible for calculating and declaring applicable tariffs accurately based on the actual legal authorities.

How to Use the Chart

  1. Locate Your Product:

    • Start in the column “Product or Country of Origin” (cell A8).

    • Scroll down until you reach the row describing your product:

      • Example 1: If your product is an automobile or auto part, stop at the first row (A9).

      • Example 2: If it is a medium- or heavy-duty truck or part, stop at the second row (A10).

      • Example 3: If it contains aluminum but is not an auto or truck, stop at the third row (A11).

  2. Read Across the Row:

    • Each column represents a Presidential Proclamation (Section 232) or Executive Order (IEEPA).

    • Gray cell: Tariff does not apply—keep reading.

    • YES: Tariff may apply—check the specific Proclamation or Executive Order for exceptions and applicable HTSUS classifications.

    • YES with a condition: Tariff may apply under certain circumstances—consult the relevant legal authority.

    • NO: Tariff does not apply—internal exceptions do not need evaluation.

Important Notes

  • A YES does not automatically mean a duty applies. Exceptions within the Proclamation or Executive Order may exempt the product.

  • The chart is intended to help identify stacking of tariffs; it does not resolve exceptions or provide final duty amounts.

  • Importers must exercise reasonable care in determining which tariffs apply and declare the correct HTSUS classifications on entry documentation.
