New Import Regulations Proposed for Polyester Fiber: USTR Requests Public Input

T

he Office of the United States Trade Representative (USTR) has announced a request for public comments and a public hearing regarding the recent determination of import injury caused by Fine Denier Polyester Staple Fiber (PSF). This action follows the U.S. International Trade Commission’s (USITC) findings that increasing imports of PSF have caused substantial harm to the domestic industry.

Background

In March 2024, the USITC began an investigation (No. TA-201-078) after a petition was filed by domestic producers including Fiber Industries LLC, Nan Ya Plastics Corp. America, and Sun Fiber. This investigation focused on whether the surge in PSF imports was damaging the U.S. industry. By July 9, 2024, the USITC concluded that increased imports were indeed a significant factor in causing injury to the U.S. PSF industry.

Next Steps and Opportunity for Public Input

To address the issue, the USITC will submit recommendations to the President by August 26, 2024. Based on the recommendations, the President can take action, which may include the imposition of tariffs, quotas, or other measures designed to help the domestic industry adjust to increased competition. These decisions must be made within 60 days of receiving the USITC’s report.

The USTR is now inviting stakeholders, including domestic producers, importers, and consumers, to provide their input on these proposed actions. Comments must address the potential remedies and their impact on the PSF industry and consumers.

What Is Being Proposed?

The USTR has outlined several possible actions that could be taken, including:

    1. Imposing or increasing duties on imported PSF.
    2. Establishing a tariff-rate quota (TRQ).
    3. Limiting the quantity of imported PSF.
    4. Negotiating agreements with foreign countries to restrict exports.
    5. Implementing import licenses or other procedures to manage imports.

  • September 9, 2024: Deadline for submitting written comments, requests to testify, and summaries of testimony.
  • September 16, 2024: Deadline for submitting written responses to initial comments.
  • September 30, 2024: Public hearing at 1724 F Street NW, Washington DC.
How to Submit Comments

Those wishing to participate can submit their comments electronically via the Federal eRulemaking Portal at Regulations.gov. The docket number for submissions is USTR-2024-0010. All comments must be in English and clearly marked with the reference “Potential Action: Fine Denier PSF.” Specific instructions for submission, including how to handle business confidential information (BCI), are detailed in the USTR announcement.
