U.S. Agricultural Tariff Exemptions Updated – Effective Nov. 13, 2025

On November 14, 2025, the White House issued a new executive order that expands the agricultural products exempt from reciprocal tariffs under Executive Order 14257. The update removes a wide range of agricultural imports from tariff coverage, with changes applying to goods entered for consumption on or after November 13 at 12:01 a.m. EST.

The action revises Annex II of Executive Order 14257 and the aligned-partner tariff adjustment list associated with Executive Order 14346. The Secretaries of Commerce and Homeland Security and the U.S. Trade Representative are directed to monitor, implement, and adjust the scope of duties globally as needed.

CBP Guidance

A CBP guidance, also issued on November 14, 2025, confirms that 237 agricultural HTSUS classifications and 11 additional categories of agricultural products are now exempt from reciprocal tariffs.

Agricultural Products Newly Exempt From Reciprocal Tariffs

The eleven categories listed in new subdivision (iii)(b) of U.S. note 2(v) include:

  1. Etrogs (0805.90.01)
  2. Tropical fruit, nesoi, frozen, whether or not previously steamed or boiled (0811.90.80)
  3. Date palm branches, Myrtus branches, or other vegetable material for religious purposes (1404.90.90)
  4. Bread, pastry, cakes, biscuits, and similar baked products, nesoi, and puddings, for religious purposes (1905.90.10)
  5. Bakers’ wares, communion wafers, empty capsules for pharmaceutical use, sealing wafers, rice paper, and similar products, nesoi, for religious purposes (1905.90.90)
  6. Acai (2008.99.21)
  7. Citrus juice (other than orange, grapefruit, or lime), Brix value not exceeding 20, concentrated, unfermented, excluding lemon juice (2009.31.60)
  8. Coconut water or acai juice (2009.89.70)
  9. Coconut water (2009.90.40)
  10. Acai preparations for beverage manufacturing (2106.90.99)
  11. Essential oils other than citrus, nesoi, for religious purposes (3301.29.51)

Subheadings to Use

  • Use 9903.01.32 for goods covered by the newly added 237 HTSUS agricultural classifications.
  • Use 9903.02.78 for goods falling under the eleven special agricultural categories identified in U.S. note 2(v)(iii)(b).

Correcting Entries and Refund Procedures

Importers should review entries filed on or after November 13:

  • Entries within the last 10 days: Correct within the 10-day window following cargo release to avoid depositing duties.
  • Unliquidated entries with duties deposited: File a Post Summary Correction (PSC) to request a refund that will be issued at liquidation.
  • Liquidated entries: File a protest within 180 days under 19 U.S.C. 1514.
