U.S. Removes Tariffs on Certain Brazilian Goods

On Nov. 20, 2025, the White House issued an Executive Order that effectively removes tariffs on Brazilian beef, coffee, and other agricultural products that previously faced a 40% levy under EO 14323 from July.

Trump cited that “various officials,” who have been monitoring the situation under EO 14323, recommended that certain Brazilian agricultural products no longer face the additional ad valorem duties. These officials noted that ongoing negotiations with Brazil have made initial progress and that domestic considerations support exempting these goods.

Newly Exempt Agricultural Products (CBP Guidance)

A CBP guidance confirms that 238 agricultural HTSUS classifications and 11 additional product categories have been added to Annex I of EO 14323.

  1. Etrogs (HTSUS 0805.90.01)
  2. Frozen tropical fruits, NESOI, whether or not previously steamed or boiled (HTSUS 0811.90.80)
  3. Date palm branches, Myrtus branches, or other vegetable materials for religious use (HTSUS 1404.90.90)
  4. Bread, pastries, cakes, biscuits, puddings, NESOI, including those with chocolate, fruit, nuts, or confectionery, for religious purposes (HTSUS 1905.90.10)
  5. Bakers’ wares, communion wafers, empty pharmaceutical capsules, sealing wafers, rice paper, and similar products for religious use (HTSUS 1905.90.90)
  6. Açaí (HTSUS 2008.99.21)
  7. Citrus juice from a single fruit (excluding orange, grapefruit, or lime), concentrated, unfermented, Brix ≤20, except lemon juice (HTSUS 2009.31.60)
  8. Coconut water or açaí juice (HTSUS 2009.89.70)
  9. Coconut water juice blends, not from concentrate, packaged for retail sale (HTSUS 2009.90.40)
  10. Açaí preparations for beverage production (HTSUS 2106.90.99)
  11. Essential oils (non-citrus), NESOI, for religious use (HTSUS 3301.29.51)

Exemptions apply to goods entered or withdrawn from warehouse for consumption on or after Nov. 13, 2025.

HTSUS Filing Requirements

  • Declare 9903.01.81 for the 238 HTSUS codes.
  • Declare 9903.01.90 for the 11 additional categories.
  • Retain supporting documentation for recordkeeping.
  • Correct prior entries filed under 9903.01.77 as needed. For unliquidated entries with deposited duties, file a Post Summary Correction (PSC) to request a refund. For liquidated entries, file a protest within 180 days of liquidation.
